Dept. of Justice and Trump team disagree on several more issues surrounding the Special Master

September 12, 2022

UPDATE: DOJ has agreed to the Trump Special Master choice of Raymond J. Dearie, a former Federal District Court Chief Judge in New York.

A lot has happened over the weekend and today in the legal fight over the documents seized from Mar-a-Lago.

I’m going to give you a quick- quick update to just get you up to speed.

Late Friday night – the trump team and the department of justice submitted their choices for who should be the special master. The DOJ put up two retired federal judges and the trump team put up one retired federal judge and one private attorney who used to be the general counsel to the former Florida Governor.

The filing shows that the former President’s team and the Department of Justice do not agree on a lot of things like which documents the special master should have access to, the workflow of the special master and who is going to pay for the special master. The Trump team thinks the two parties should split the cost and the DOJ says no – team Trump is demanding this special master, they should pay for it. They also disagree on how long the review should take. The DOJ wants it over by October 17, the Trump team wants 90 days.

Keep in mind, last Thursday – the Department of Justice filed a motion asking the same judge to put a pause – or stay—on her ruling for a special master because the DOJ is appealing her ruling to the 11th Circuit. I told you all about that in this video last week.

Today – three things happened.

The trump lawyers filed a 21-page opposition to the Department of Justice’s motion to have the Florida judge stay her ruling. They don’t want her to do that. They want to move forward with the special master exactly as the judge ruled.

The Trump lawyers filed short 3-page opposition to the candidates the department of justice submitted for a special master. They don’t like either of the DOJ’s choices.

It is likely we’ll be seeing a similar filing from the DOJ over the Trump team’s two special master selections soon.
