The Supreme Court just issued an emergency order saying President Biden’s regulations on ghost guns must stay in place…for now.
Last year the Bureau of Alcohol, Tobacco, Firearms and explosives issued a regulation that broadened the bureau’s interpretation of the word “firearm” in the Gun Control Act of 1968 to include so called ghost guns. I actually told you all about it when it happened in this video. The regulator did not ban the sale or possession of the kits or components that make up these guns, but instead required the manufacturers and sellers to obtain a license, mark their products and pieces with serial numbers and conduct background checks.
Gun owners and advocacy groups sued saying this regulation is not authorized by the 1968 law and a federal judge in the Northern District of Texas agreed with them striking down the regulation. Then the 5th Circuit Court of Appeals ruled with the lower court judge and did not intervene.
Well today the Supreme Court did. In a 5-4 ruling, the court said the Biden administration policy regarding ghost guns must stay in place while this case continues to play out. Chief justice Roberts along with justices Barrett, Sotomayor, Kagan, and Jackson were all in the majority. They gave no explanation for their ruling nor did the four conservative justices who dissented.
