The Special Counsel has all the data from a cell phone former President Trump was using while he was President on January 6th and smith has every intention of using that information against Trump.
That’s according to a notice filed in DC federal court tonight.
Yeah – I know it’s been a busy day for Special Counsel Jack Smith. I told you earlier today in this video about a request he made that was granted by the Supreme Court in this same Trump case.
But this short three-page filing is interesting.
In it Special Counsel Smith is giving the court and the Trump legal team notice that he plans to call three expert witnesses during the election interference trial that’s set to begin in March. That’s not so interesting.
But what is interesting is what these three experts are going to testify about.
So it’s pretty common knowledge that former President Trump doesn’t text or email…but we all know he talks on the phone and at the time – he was definitely tweeting and we know generally where he was on January 6th.
Experts one and two will testify about the Google location history that was gathered from a search warrant from that cell phone and others in Trump’s orbit to give the jury insights on where people were moving on January 6th both around the Capitol area but also the Ellipse where Trump made that infamous speech.
And the third expert will testify about the analysis downloaded – again – after a search warrant was executed – from the cell phone trump was using. That information includes apps that were being used and the data extracted from Twitter – including meta data of when Tweets were created, changes made to tweets, DM information and draft tweets that were never sent. But that’s not all – this expert will testify and analyze the images found on the phones and will discuss the website browsing history on that phone during the post-election period and on and around January 6th.
This testimony could reveal day-to-day details of Trump’s final weeks in office, his daily movements, his twitter habits and how the people around him were behaving. But it’s important to note – this filing does not claim explicitly that the expert will be able to prove that activity on the phones directly involved Trump. Trump’s phones were routinely managed by others.
