Former President Trump has just appealed the ruling by Maine’s Secretary of State that kicked him off that state ballot for violation of the 14th Amendment. And it looks like Trump wants the state courts to hear this case in two weeks.
This appeal was filed in Maine state superior court by the Trump legal team a short time ago and gives four main reasons for the appeal including–one– the Secretary of State Shenna Bellows according to Trump — is biased against him and should have recused herself. Two—Secretary Bellows had no legal authority under the state law to remove Trump from the ballot because the 14th Amendment is a federal constitutional issue not a state one. Three – Secretary Bellows made “multiple errors of law” and relied on bogus evidence because Trump is not an insurrectionist. And four – if Bellows’s ruling is allowed to stand, Trump will be “illegally excluded” from the ballot.
I reported in this video last week that Secretary Bellows ruled after a hearing in mid-December that Trump violated the 14th Amendment of the constitution and therefore was disqualified from appearing on the state’s ballot. Now – Maine is different from other states in that the Secretary of State is responsible for determining who is qualified for the ballot. And it’s under that authority that Secretary Bellows removed Trump
Well – now the former President wants the state courts to get involved. And it’s very possible this case will be appealed all the way up through the state and could be appealed eventually to the Supreme Court. The former President’s team and Secretary Bellows have proposed an expedited timeline for the courts to hear this case with oral arguments proposed for January 16th.
It is important to keep in mind – we are anticipating the former President will be appealing Colorado’s Supreme Court ruling to the US Supreme Court any minute. As I told you in this video Colorado Supreme Court also found trump violated the 14th Amendment and therefore should be disqualified from that state’s ballot.
