Breaking news – the United States Supreme Court has just decided they will get involved and will ultimately decide once and for all whether former President Trump has “absolute immunity” when it comes to the multiple federal criminal charges he’s facing. That means trump’s federal legal prosecutions are going to stop. … for now.
The Supreme Court just issued this order granting former President Trump’s request to not only hear his appeal of the Washington DC appeals court which strongly decided there is no such thing as absolute immunity for anyone in the United States including the president– but also pause that ruling so basically none of Jack Smith’s federal prosecutions of trump can move forward.
Now –very important — the Supreme Court said they are *only* going to decide one question. Whether – and if so – to what extent does a former president enjoy presidential immunity from criminal prosecution for conduct alleged to involve official acts during his tenure in office.
As I have been reporting – former President Trump has been arguing in multiple of his criminal cases, that he cannot be criminally prosecuted for his alleged actions related to 2020 election interference because he was acting in his official capacity as president. He also just argued he has absolute immunity when it comes to those classified documents that were found at Mar-a-Lago.
So now what? The Supreme Court will hear oral arguments in this absolute immunity case on April 22nd. Between now and then, there will be briefs filed with the supreme court from trump’s team and from special counsel Jack Smith. In reality this means – we probably won’t get a ruling on whether or not trump has absolute immunity until maybe may – maybe not until the end of June. Which – depending on the ruling will push the trials into crucial election timing. So what this really means is – it’s now very possible this move by the Supreme Court today has just delayed all of Trump’s federal criminal trials until after the 2024 election. And if he wins – it’s likely – he will make all of these federal cases disappear.
