Special Counsel Jack Smith just said hold up! He wanted to get one more word in to the Supreme Court before they decide whether they are going to get involved in answering the question – does former President Trump have “absolute immunity” from prosecution.
The special counsel filed this short 11-page response this morning to the court stressing the gravity of this issue and the importance of the court weighing in right now and not waiting until the appeals court decides.
Smith says Trump’s argument – which I told you all about in this video yesterday — that the court should say out of this decision for now is misguided. Smith says this is a massive constitutional issue that’s going to come up repeatedly in the criminal cases involving trump so ruling on it now is imperative. He says “the public interest in a prompt resolution of this case favors an immediate, definitive decision by this court. The charges here are of the utmost gravity. This case involves—for the first time in our nation’s history—criminal charges against a former president based on his actions while in office.”
The Special Counsel reiterates his argument that the supreme court has done this exact same thing before in 1974 with former President Richard Nixon in the Watergate case. The took the case, heard oral arguments and ruled –all within about 6 weeks. But when it comes to Trump – Jack Smith says “here, the stakes are at least as high, if not higher: the resolution of the question presented is pivotal to whether the former President himself will stand trial— which is scheduled to begin less than three months in the future.”
A decision on whether the Supreme Court will even get involved in this case could come at any minute.
