RFK Jr. scored two major victories today in his fight to get his name removed from the ballots in three key swing states. And this should matter to you even if you don’t live in a swing state.
In North Carolina an appeals court ruled this afternoon that Kennedy’s name must be taken off the ballot. That means instead of absentee and mail ballots being sent out today to hundreds of thousands of voters in all 100 counties– as North Carolina law orders – all those ballots will be thrown out, reprinted and repackaged at the taxpayer’s expense. Elections officials say it could also take weeks to get done. The appeals judges gave no legal reason why they were overturning a lower court’s ruling issued yesterday that said Kennedy’s name must stay on the ballot.
But RFK Jr. wasn’t just successful in North Carolina – he was also successful in Michigan where another appeals court did the exact same thing today. Reversing a decision made by a lower court judge. The appeals court said Kennedy’s name must be removed from the ballot because the state law outlining the deadlines for a candidate to withdraw only applies to state candidates not to candidates for president.
Now – both of these decisions are going to be appealed to the North Carolina and Michigan supreme courts. So this can all change again and Kennedy name could ultimately stay on these ballots. But regardless — time is of the essence. Ballot deadlines are looming or in the case of North Carolina have already passed.
And in Wisconsin – today — a judge said he’s not ready to make a decision and instead he wants to hear more about why Kennedy thinks he’s entitled to have his name removed from the ballot after he missed the state deadline. The judge is going to have a scheduling conference next week in this case – which is just one week before the absentee ballots go out in the mail.
But why should you care if you don’t live in any of these states.
Well – as I explained in this video yesterday – in an extremely tight election like this one – this is all going to come down to about 100-thousand voters in a few swing states.

And before he dropped out – RFK Jr. qualified to get his name on the ballots in almost two dozen states.
Including these three swing states. North Carolina, Michigan and Wisconsin. But after he suspended his presidential campaign he said he wanted to keep his name on the ballots in all these purple states but he wanted to get his name removed from the three swing states because he was concerned that his presence on those ballots would pull votes away from former President Trump – who of course, he now endorses. And when the race is tight – every single vote counts.
