President Biden just announced perhaps the most aggressive immigration and border executive action since he took office. And that has obviously pissed off a lot of people.
So here’s what the order does.
Starting at midnight tonight, asylum seekers attempting to enter the United States between border crossings will be barred from entry into the United States when the number of illegal border crossings is high.
So what’s classified as “high?” The order says border patrol agents will block asylum-seeking migrants who are trying to enter illegally when illegal entries reach an average of 2,500 per day for seven consecutive calendar days.
Those asylum-seeking migrants who try to enter illegally and are turned away will be sent back to Mexico or their home country unless – they express convincing fear of persecution that would qualify them for an exemption and then would require them to go through an intense screening process. But if their asylum claims don’t pass that screening process they too will be barred from entry.
Unaccompanied minors will be exempt and so will asylum seeking migrants who are determined to be victims of trafficking. This also does not apply to asylum seeking migrants who enter legally through the current system.
When daily migrant encounters reaches a daily average of less than 1,500 for seven consecutive calendar days this block on asylum seeking migrants will stop. But then when they go up over that 2,500 average it will be enacted again.
Now if this seems familiar – it should – it is very similar to a policy former president trump tried to enact while he was in office. The courts blocked him then and it’s very possible the courts will block this action of President Biden now. The a-c-l-u has already said it will sue the Biden Administration to stop this from taking effect.
Biden says he knows executive action won’t fix the problem. The fact is – as I have reported repeatedly, the only way this border issue gets fixed is if congress passes comprehensive immigration law – which they have repeatedly failed to do.
