If you’re relying on the federal eviction moratorium to keep you in your home – it’s over.
The Supreme Court struck down the Biden Administration’s extension of the eviction moratorium. I actually said this would most likely happen when I first reported the extension a few weeks ago. As expected the high court said the CDC overstepped its authority to issue the moratorium in the first place and if the Biden Administration wanted it extended it had to go through congress.
At this point, congress is on recess until late September and there’s no real movement by lawmakers to create any legislation to extend the eviction moratorium any further.
So what does this mean? Well, it means your landlord can immediately begin the eviction process for non-payment and it means you will be responsible for all of the back rent that you didn’t pay.
It’s possible your state or county may have some sort of eviction moratorium or protection for you, but it’s up to you to call and find out.
The Biden Administration is also working to speed up the process of getting the remaining tens of billions dollars of rental assistance payments out to those who need it. That process has been extremely slow for several reasons including antiquated state systems to distribute the money and problems verifying the needs of applicants.
