The FDA announced today that it is reversing its ban on e-cigarettes made by JUUL.
Now – you may not have even known JUUL products were banned in the United States because they’ve remained on the store shelves. But the fact is back in June 2022 the FDA banned the marketing of e-cigarette products from JUUL because the FDA said the company’s application lacked sufficient evidence that the toxicology of the products met the public health standard required by law. The company sued and then in July of 2022 the FDA back peddled and said they’d put their ban on hold.
So what changed between 2022 and today? Well – the FDA put out this statement today saying “the FDA has gained more experience with various scientific issues regarding e-cigarette products.” The agency went on to say the courts have established new case law when it comes to e-cigarette products which the FDA is now following.
Juul says they are pleased with today’s move by the FDA saying — “we remain confident in the quality and substance of our applications and believe that a full review of the science and evidence will demonstrate that our products meet the statutory standard of being appropriate for the protection of public health.”
It’s important to know — just because the FDA is reversing its ban on these products does *not* mean that the FDA has approved JUUL’s request to market its products. This move today just moves JUUL’s application back to the “pending review” status. It’s unclear when or if the FDA will ever approve JUUL’s application.
