Huge Supreme Court rulings are coming down tomorrow and Friday…the question is – which ones?
Well…the answer is we don’t’ know. But we can use the process of elimination to figure out which rulings are left from all the big cases the justices heard this term. I’m only going to highlight the major cases I covered and I’m not saying these are the ones that’ll be released tomorrow and Friday – I’m just letting you know what’s still out there.
Obviously one of the biggest cases that the justices haven’t ruled on yet — is former President Trump’s absolute immunity case. He wants the Supreme Court to rule that because he was acting in his capacity as the President of the United States he should have absolute immunity from any crime he may have committed. If the supreme court agrees – you’ll see a massive shift in trump’s prosecutions for election interference…. And maybe even charges dropped. Whether the justices go that far is unclear.
We are also waiting on a highly controversial gun case ruling. In United States vs Rahimi the justices will answer the question does someone with a court-approved domestic violence restraining order have a 2nd amendment right to also possess guns? The 5th circuit court of appeals says yeah they do. We’ll have to see what the justices say.
The justices will also rule on a major social media and free speech case. The justices will rule on whether social media companies – which are private businesses — have a first amendment right to remove certain political posts or accounts. The states that are suing say the companies are violating the first amendment rights of the people who post. So the justices are going to decide whose first amendment rights will prevail.
January 6 defendants are also waiting on the Supreme Court. That’s because the justices will decide whether the charge of obstructing an official proceeding was improperly added to the list of charges for hundreds of defendants. If the justices say the department of justice was wrong in its application of that criminal statue — the cases of those particular defendants will be significantly impacted. Some may see reduced sentences or even charges dropped.
Lastly — we are waiting for the justices to rule on the questions …what is taxable income? And how far can congress take its power to tax under the 16th amendment. The court’s decision in this case could cause a lot of chaos in our current tax system and could significantly reduce congress’s ability to tax the super rich.
