Former President Trump’s limited gag order has temporarily been put on pause by an appeals court. Now – that does not mean it’s going away.
Before I explain what just happened just a little bit ago…I want to remind you of what gag order I’m talking about.
This is the limited gag order that was put in place by judge Tanya Chutkan in the Washington DC federal case involving election interference being brought by special counsel Jack Smith.
I told you all about that order in this video when the Judge Chutkan originally issued it a few weeks ago. That order allows the former President to talk about this case generally and all the ways he feels he is being unfairly prosecuted. He can talk about the judge. He can talk about the justice department. And he can talk about the Biden Administration and all the ways Trump believes this case is a political attack. But, according to Judge Chutkan’s order, trump cannot attack special counsel Jack Smith, or his staff or family, nor can he attack court staff or witnesses.
Well Trump’s legal team says that violates his 1st Amendment rights and they appealed it to the federal appeals court in the District of Columbia. Today – a three judge panel made up of judges appointed by Presidents Obama and Biden decided to temporarily freeze the limited gag order. Now – the panel’s decision today was not a decision on the merits of judge Chutkan’s ruling it was just a decision to temporarily put the limited gag order on pause until the panel can hear oral arguments on November 20th.
